Bail Amount or Bond Needs To Be Set
After booking the defendant into jail, the arresting officer files his/her report (probable cause affidavit) with the court. The Magistrate Judge will review the present charges and the defendants past criminal history to determine the bond amount. Once a bond amount has been set, there are several ways to be released from jail. Several examples of these ways are Personal Bonds, Cash Bonds and Surety Bonds.
Personal Bond
At some point after someone has been arrested, they will be interviewed by the Travis County Pre-Trial Services Office to see if they potentially qualify for a personal bond. If they meet the necessary qualifications, then the accused will be required to pay a $20 PR fee to the office. The Pre-Trial Services Office uses strict criteria to determine if a person is eligible for a personal bond and, very often, a person will not be approved for a Personal Bond unless an attorney is retained. When a person is arrested late at night, they will usually not be seen by the judge to have their bond amount set until the next day or even later. Also, depending on the number of individuals arrested at the time, it can take the Pre-Trial Services Office over 12 hours to approve or deny a bond for an individual. However, most detainees want to be released much sooner than that. Cash Bail Bond
A cash bond is simply depositing the FULL AMOUNT of the bond with Travis County. The only forms of payment accepted are cash, cashier’s checks or money orders for the amount of the bond. Usually cash bonds are not the best option for someone trying to be released from jail. Cash Bonds are usually the most expensive type of bail bond.
1) When bonds are set in the thousands of dollars, many people simply do not have access to the funds to secure the release.
2) The money remains deposited with the County until the case is resolved – which could be several months or even longer.
Surety Bonds (Bail Bondsman)
Sometimes it is necessary to hire an Austin bail bond company to assure the bond amount before someone is released from jail. Bail bondsmen in Austin typically charge at least 10-20% of the bond amount to get someone out of jail. In some circumstances, this percentage can be higher. A bail bondsman will usually require a cosigner on the bond, possibly making the cosigner personally liable for the total bond amount if for any reason the bond is revoked or forfeited. Often times a cosigner may even have to offer collateral of up to twice as much as the bail bond amount.
Another disadvantage of hiring a bail bondsman is that it is usually the most expensive route in getting released from jail. As previously mentioned, bail bondsman often times cost much more than the other options and the money used to hire a bail bondsman can never be put toward the attorney’s fees in a case. In most cases, we can apply part or the entire jail release fee towards the legal fees in representing the accused in the criminal matter that led to the arrest if Kevin Bennett is retained for the criminal case. How long does it take to get out of jail?
This is by far the most common concern for both our clients in the Travis County Jail and their friends or family members trying to get them released. The simple answer is that there is no set period of time that a person will spend in jail before being released. Why is this? First, a person has to be booked into the jail and all internal documentation has to be turned in and completed. Depending upon various factors at the jail, including the number of people in jail that have recently been arrested, it could easily be later the next day until a bond amount is even set.
However, the goods news is that in most circumstances, an attorney can get someone out of jail much quicker and for less cost than a person who does not call an attorney. How is this possible? Attorneys licensed in the State of Texas are able to interview the client in jail, gather the necessary background checks, fill out the necessary bond paperwork, and can meet with a judge and request that bond be set. Please be aware that the person will likely be in custody for a minimum of 6 hours before he or she can be released and that it will usually take 4-6 hours for somebody to be released from jail once the judge signs the bail bond and the lawyer turns it into Central Booking.
