  • Charge: Driving While Intoxicated-2nd
  • Result: Dismissed on day of trial as jury selection was to begin.
  • Allegations: New Years Eve. Client observed stopped in middle of service road connecting the 6th Street entertainment district to Interstate 35. Client later observed weaving on Interstate. Client eventually stopped for speeding. Client had strong odor of alcohol, bloodshot and glassy eyes and was swaying. Client failed all field sobriety tests and admitted to consuming alcohol. Client faced enhanced DWI charge due to prior DWI conviction.
  • Charge: Driving While Intoxicated
  • Result: Case Dismissed
  • Allegations: Police observed Client stopped in intersection at 2:29 A.M.  Client had strong odor of alcohol, slurred speech, bloodshot eyes, watery and glassy eyes and was swaying.  Client failed all field sobriety tests and admitted to having just left bar. Client admitted to drinking.
  • Charge: Felony Driving While Intoxicated 3rd or More
  • Result: Motion to Suppress Evidence Filed. Case Dismissed.
  • Allegations: Police observed Client stopped on side of road at 3:19 A.M. Client drove away when police approached. Client had strong odor of alcohol, slurred speech, bloodshot eyes, watery and glassy eyes. Client admitted to drinking. Search warrant for client's blood issued. BAC was almost twice the legal limit.

  • Result: Motion to Suppress Evidence Filed. Case Dismissed just prior to hearing.
  • Allegations: Austin DWI task force officer stopped client for speeding. Client admitted to having just left bar. Client admitted to drinking. Client failed all field sobriety test. Client failed portable breath test at scene of arrest and failed Intoxilyzer 5000 breath test at Travis County Jail. 
  • Charge: Driving While Intoxicated
  • Result: SWAP
  • Allegations: Client arrested at 2:23 A.M., after colliding with parked DPS vehicle. Collision caused Client’s vehicle to completely flip over onto its roof. Client observed to have strong odor of alcohol, blood shot eyes, slurred speech and to be swaying. Client failed all field sobriety tests and admitted to consuming beer and shots of liquor. BAC over .15.
  • Charges: Driving While Intoxicated; Assault Causing Bodily Injury to a Family Member
  • Result: Both Cases Dismissed
  • Allegations:  Client pulled over in downtown area of Austin for driving 30 MPH over the speed limit. Client observed to have a strong odor of alcohol, glassy eyes and to be disoriented. Client failed all field sobriety tests. Client had bottle of vodka and beer in vehicle, including an open can of beer. At time of arrest, Client had pending case for Assault Family Violence Charges.
  • Charges : DWI; Resisting Arrest; Felony Attempt to Take Weapon from Officer
  • Result: Driving While Intoxicated-Dismissed; Resisting Arrest-Deferred Adjudication; Felony Attempt to Take Weapon from Officer-Dismissed; Avoided Higher Charge of Felony Assault on a Public Servant
  • Allegations: Client committed traffic violation after observed leaving bar. Client was slow to pull over. Client admitted to being on way to “continue the party.” Client resisted attempt of being handcuffed. Client tazed multiple times after struggling with officer to gain control of tazer. Several officers were eventually able to place client under arrest. Client had glassy eyes and strong odor of alcohol coming from breath. A cup of vodka was found in center console of vehicle, as well as an almost completely empty bottle of vodka and a bottle of brandy.
  • Charges: Driving While Intoxicated-2nd; Possession of Marijuana
  • Result: Both Cases Dismissed
  • Allegations: Police called after witness observed Client strike curb and run onto highway median.  Client stepped out of vehicle and vehicle rolled forward. Client got back in vehicle and drove away with emergency brake on.  Client eventually pulled over due to flat tire. Client swayed, wobbled and had slurred speech. Client failed field sobriety tests.  Client faced enhanced DWI charge due to prior DWI conviction. Upon arrest, marijuana and smoking pipes were found in center console of vehicle.  
  • Charge: Driving While Intoxicated
  • Result: Dismissed
  • Allegations: Client pulled over for driving 90 MPH in a 60 MPH zone.  Client had strong odor of alcohol and bloodshot, watery and glassy eyes. Failed field sobriety test.  Admitted to consuming alcohol. Multiple open cans of beer found in vehicle. BAC over .08.  Client under 21.
  • Charge: Driving While Intoxicated
  • Result: Dismissed
  • Allegations: Client pulled over for driving without headlights. Windshield wipers were on, despite fact that it was not raining. Client stumbled while exiting vehicle. Watery eyes, slurred speech and odor of alcohol coming from breath. Client admitted having just left downtown. Client admitted to drinking beer. Client failed field sobriety test. BAC over .15.
  • Charge: Driving While Intoxicated-2nd
  • Result: Dismissed
  • Allegations: Police were dispatched to road rage call involving Client. Client pulled over at 2:59 A.M. Client had bloodshot eyes, odor of alcohol and swayed. Client failed field sobriety test. Clients DWI arrest was enhanced due to a prior conviction.

  • Allegations: Police observed Client stopped driving without headlights at 12:09 am.  Client had moderate odor of alcohol, bloodshot and glassy eyes. Client failed all field sobriety tests and admitted to having consumed alcohol. Client provided breath and blood specimen over legal limit.

  • Result: Not Guilty via Jury Trial
  • Allegations: Police called by upstairs neighbor. Neighbor claimed to have witnessed Client drag his girlfriend up a flight of stairs by her hair. Alleged Client smashed furniture and other items in apartment and was beating on girlfriend. Client had extensive criminal history.
  • Charge: Felony Assault Family Violence by Strangulation; Felony Violation of a Protection
  • Result: Felony Assault Family Violence Dismissed; Felony Violation of a Protection Order-Deferred Adjudication; Avoided Felony Injury to Child Charge; Avoided Prison
  • Allegations: Client strangled girlfriend, as she held young child. Incident was alleged to have caused a scratch and bruising to child. Client was arrested for felony assault and a protective order was issued.  Soon after protective order put in place; Client arrested a second time for similar allegations that he choked the same girlfriend. Victim claimed that Client also punched her, dragged her by hair and slammed her head against the ground repeatedly. Witness told police that it sounded like someone was bouncing a basketball against the floor in the above apartment. Client faced up to 10 years in prison on each charge.

  • Result: Deferred Adjudication on Reduced Charge of Injury to a Child
