Recent DWI Case Results
- Charge:Felony Driving While Intoxicated with Child Under 15 Years of Age
- Result:Felony DWI Dismissed
- Allegations:Client driving home from wedding with 4-year-old child. Client crashed vehicle into ditch and totaled vehicle. Admitted to drinking 4 beers. Failed field all sobriety test. Client had a .14 BAC.
- Charge:Misdemeanor Driving While Intoxicated w/ Open Container and Unlawful Carrying of Weapon
- Result:Both Cases Dismissed
- Allegations:Client pulled over at 1:40 am after Bee Cave Police observed Client weaving and crossing over adjacent lanes multiple times and almost struck another vehicle. Client had strong odor of alcohol, red bloodshot, watery and glassy eyes, and was swaying and staggering. Client’s speech was slurred and mumbled. Client admitted to being in a motor vehicle accident and leaving the scene. Client had .16 BAC. Client had loaded firearm in the vehicle at time of arrest.

- Allegations:Client involved pulled over after officer witnessed several different traffic violations, including drifting into neighboring lanes. Search warrant issued for Client’s Blood. Client had a .12 BAC. Defense argued that Client’s BAC was under .08 at the time of operation of motor vehicle and that Client’s performance on field sobriety test were noticeably better than arresting officer’s report and testimony.

- Allegations:Client crashed into a guardrail at 2:17 AM after leaving a friend’s house. Admitted to drinking beer and tequila for a period of over 6 hours prior to leaving the house. Client failed all field sobriety test. A search warrant was issued for client’s blood. Client had a BAC of .16.

- Allegations: Client arrested at 2:23 A.M., after colliding with parked DPS vehicle. Collision caused Client’s vehicle to completely flip over onto its roof. BAC over .15.

Client admitted to being on way to “continue the party.” Client resisted attempt of being handcuffed. Client tazed multiple times after struggling with officer to gain control of tazer. Several officers were eventually able to place client under arrest. Client had glassy eyes and strong odor of alcohol coming from breath. A cup of vodka was found in center console of vehicle, as well as an almost completely empty bottle of vodka and a bottle of brandy.

- Result: Both Cases Dismissed
- Allegations: Police called after witness observed Client strike curb and run onto highway median. Client stepped out of vehicle and vehicle rolled forward. Client got back in vehicle and drove away with emergency brake on. Client eventually pulled over due to flat tire. Client swayed, wobbled and had slurred speech. Client failed field sobriety tests. Client faced enhanced DWI charge due to prior DWI conviction. Upon arrest, marijuana and smoking pipes were found in center console of vehicle.

- Result: Probation on Reduced Misdemeanor Charge of Attempted DWI with Child Under 15 Years of Age
- Allegations: Police received calls of client swerving all over road. Police find client stopped and falling down by side of road. Witnesses identified Client as driver. Client failed all field sobriety test and had BAC was over .15. Client had 3 children under the age of 15 in vehicle.

- Allegations: Police called by upstairs neighbor. Neighbor claimed to have witnessed Client drag his girlfriend up a flight of stairs by her hair. Alleged Client smashed furniture and other items in apartment and was beating on girlfriend. Client had extensive criminal history.
- Charge: Felony Assault Family Violence by Strangulation; Felony Violation of a Protection
- Result: Felony Assault Family Violence Dismissed; Felony Violation of a Protection Order-Deferred Adjudication; Avoided Felony Injury to Child Charge; Avoided Prison
- Allegations: Client strangled girlfriend, as she held young child. Incident was alleged to have caused a scratch and bruising to child. Client was arrested for felony assault and a protective order was issued. Soon after protective order put in place; Client arrested a second time for similar allegations that he choked the same girlfriend. Victim claimed that Client also punched her, dragged her by hair and slammed her head against the ground repeatedly. Witness told police that it sounded like someone was bouncing a basketball against the floor in the above apartment. Client faced up to 10 years in prison on each charge.

- Allegations:Client arrested for pulling a loaded firearm on another individual after a verbal altercation. Client arrested and indicted. Client maintained self-defense and Defense able to convince the Travis County District Attorney’s Office that Client was defending himself.
- Charge:Felony Deadly Conduct Discharge of Firearm in Direction of Habitation
- Result:Case Dismissed
- Allegations:Client fired multiple shots from a high-powered rifle towards a neighbor’s home during a nighttime thunderstorm. Client was witnessed doing this by another neighbor who happened to be a police officer. The alleged victim neighbor found a projectile round on her property. Client’s statements to police were inconsistent and Client eventually admitted to possibly firing his AK-47 that night but couldn’t be certain that he did.

- Allegations:Client faced 10 years in prison after second motion to revoke Client’s probation was filed. Client arrested for 4th DWI while already on felony probation for felony DWI. State also alleged numerous violations of terms of probation, including continued alcohol use and multiple positive breath tests on intoxilyzer in vehicle.

- Allegations:Client faced up to 1 year in jail and up to a $4000.00 fine while on probation for their 2nd Defense Attorney had already previously helped client get their 3rd DWI dismissed. After picking up their 4th DWI in West Texas, Client now faced a motion to revoke probation on this DWI-2nd probation. State alleged numerous violations of terms of probation, including the new DWI arrest, continued alcohol use, and multiple positive breath tests the ignition interlock device in client’s vehicle. Defense Attorney worked with defense counsel in West Texas to help keep Client on Travis County probation and also out of prison on the 4th DWI.
